The terms “Nat-Ts”/“NAT-TS”, “we”, “us”, and “our” refer to NAT-TS LIMITED. The terms “you”, “your”, and “yours” refer to anyone accessing or using the Site. “Site” refers to NAT-TS.COM, an e-commerce website owned and operated by NAT-TS, hosted on the Wix.com platform.

 

We reserve the right to revise these Terms and Conditions (“Terms”) at any time without notice. It is your responsibility to regularly check these Terms and Conditions for any changes. Continued use of the Site will be taken as your acceptance of those changes. Changes will not apply to any orders we have already accepted unless the law requires. Shipping and Delivery Policy

 

You are required to pay shipping/delivery charges in addition to the price of the Products you order. These charges are itemised on the Site’s Checkout Page and in your Order Confirmation email.

 

Couriers or postal services (delivery agents) are nominated by the third-party print providers.

 

Your order will be fulfilled as soon as possible. NAT-TS’ designs are printed by print providers worldwide. Depending on the distance between you and the printer, delivery may take, on average, from 2 to 30 days after production. Deliveries are usually made during local business hours of 9am to 5pm, Monday to Friday, and generally do not include weekends and statutory holidays.

 

 

Our “Shipping Confirmation” email notification to you marks the time when shipping has commenced; it does not mean that all items in the order have shipped at that time. The Shipping Confirmation email will itemise the Products dispatched/shipped at the time.

 

Once Products have been dispatched, they have moved beyond our control. NAT-TS is not able to follow up directly with delivery agents. It is the responsibility of the customer to liaise with the delivery agent in relation to date and time of delivery. For an update on your order, please contact the delivery agent with your order number, or use the tracking number or link on your Shipping Confirmation email. NAT-TS does not take any responsibility for lost parcels during transit.

 

Shipping, particularly for international orders, is affected by many outside influences. From time to time, for reasons outside our control (for example during high-traffic seasons like Christmas), delivery agents can become overwhelmed and customers can experience some delays. NAT-TS is not responsible for the delivery times of Products and does not accept any liability for loss or damage suffered by anyone as a result of any such delays.

 

On the odd occasion that a customer lives outside of the ‘normal’ delivery areas of the delivery agents, packages may be passed to Forwarders for delivery. This may result in a small delay in delivery and your tracking may show prematurely as being ‘delivered’. In this instance, please contact the delivery agent to clarify the location of your order.

 

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address, or wrong person, as a result of you providing us with inaccurate or incomplete information. We do not deliver Products to PO Box addresses.

 

Your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

 

 

Your Account

 

Creating an online account, and a password to access your account, is optional. If you choose to create an account, your password must be unique and kept secure and private at all times. You are solely responsible for maintaining the security and privacy of the information you submit and the corresponding password, and for restricting access to any device with saved access to your account. You agree to accept responsibility for all activities that occur under your account or password. Please contact us immediately if you believe there has been a breach of security, or any unauthorised use of your account, by emailing nat-ts@outlook.com, or through our Contact Form, which can be accessed via the “Contact” tab in the header of each Site page.

 

You agree that all personal information you provide to us through your account is up-to-date, accurate and truthful, and that you will update your information as it changes. Providing personal information is optional. If you choose not to enter certain information, we may be unable to sell or deliver products to you.

 

We reserve the right to terminate your account for any reason, and to remove or edit Content submitted through your account and/or your account identity.

 

 

Site Access

 

The Site is provided on an “as is”, “as available” basis. NAT-TS does not warrant that use of the Site will be uninterrupted, and is not liable for any discontinuance, interruption, suspension or other limitation of the Site.

 

You expressly agree that your access to, and use of the Site is at your sole risk.

You must take your own precautions to ensure that your process for accessing the Site does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer/mobile device. We take no responsibility for any damage which may arise in connection with your use of the Site.

 

NAT-TS may at any time and without notice terminate, restrict, or suspend your access to the Site, or any feature or Content of the Site, for any reason, including violation of any applicable law or breach of these Terms.

NAT-S is an online e-commerce shop and will primarily communicate via email. It is your responsibility to ensure that you provide us with your correct contact details, and that the nominated email address is regularly checked for correspondence.

 

If you do not receive an Order Confirmation, or other expected email from us, please check your nominated email account’s spam and/or junk box in the first instance, then contact us by emailing nat-ts@outlook.com, or through the Contact Form on the Site.

 

NAT-TS does not guarantee the delivery or security of communications over the Internet, as such communications rely on third-party service providers.

By including #NatTs in images and content you post on social media or other online platforms, you consent to us reposting and sharing your content via our Site and social channels including, but not limited to, Instagram and Facebook.

These Terms and Conditions govern the sale of goods (“Products”) available on our Site and apply to all the products displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our products are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as these may have been sourced from third parties, and we cannot guarantee the accuracy of such. All weights and dimensions of products described in the Site are approximate.

 

Depending on the screen you use to view the Site, the colours of products as displayed may not constitute an accurate depiction of the true colour of the item.

 

You agree to purchase products from our Site at your own risk.

 

 

Pricing and Availability of Products

 

Pricing of products may vary by country as they may be subject to import duties and taxes charged by the destination country. You are responsible for paying any such duties or taxes. All prices listed on the Site exclude delivery costs, which are itemised on the Checkout Page.

 

Prices and availability of products on the Site are subject to change at our sole discretion and without notice. Errors in pricing will be corrected when discovered. Where an order has been placed, but not yet dispatched, and a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product. If a product’s correct price is higher than the price stated on our Site, we will, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection by email. We may rescind our acceptance and cancel your order where there has been an obvious error in price.

 

Our products can sell quickly. On rare occasions, you may be able to place a product in your shopping cart, submit your order for processing, and receive an Order Confirmation from us, but the product is no longer available. You agree that we may rescind our acceptance and cancel your order without penalty if we are unable to ship the product due to unavailability.

 

 

Special Offers

 

From time to time NAT-S may run special offers and discounts which may be subject to additional and separate Terms and Conditions. Any additional Terms and Conditions will be made available on our Site. Using a special offer or discount constitutes acceptance of the Terms.

Ordering Through Our Site

 

By placing an order through the Site, you are making an offer and commitment to purchase the ordered products in accordance with these Terms. An order is subject to acceptance or rejection by NAT-S at our sole discretion. Rejection of an order will be communicated to you by email.

 

After placing an order, you will receive an “Order Confirmation” email from us acknowledging that we have received your order. This does not mean that your order has been accepted. A contract with us will only be formed when we dispatch the product. The contract will relate only to those products whose shipment we have confirmed. We will not be obliged to supply any other products which may have been part of your order, or in a separate order.

 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary, provided you have not accepted delivery of the products. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

 

Payments

 

When you provide us with your payment information, you authorise our use of, and access to, the payment instrument you have chosen to use, and to charge the amount due to this payment instrument. You must provide complete, true and up to date payment and billing details. You must be the authorised holder of the payment instrument, or be authorised to use the payment instrument, in order to have payment details authorised and processed.

 

Payment for orders will be processed immediately upon acceptance of your order. If we are unable to successfully process your payment, then we may cancel your order. If we believe your payment has violated any applicable law, or these Terms, we reserve the right to cancel or reverse your transaction.

 

You can choose the currency displayed on the Site by using the currency converter at the top of each Site page. Currency rates are provided by XE: https://www.xe.com/currencyconverter/. The currency converter does not change the currency of sale transactions.

 

We accept Credit/Debit Card payments through Stripe and PayPal payments on our Site, to offer PCI Certified Service Providers in accordance with best industry practice.

All Content contained on the Site is protected by New Zealand and international copyright laws, trademarks, rights in databases and/or other proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. You may not participate in the transfer or sale of; create derivative works from or adaptations of; market, advertise, promote or in any way exploit any of the Content, in whole or in part, without our express, prior written consent.

NAT-TS and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any direct, indirect, incidental, special, or consequential actions, claims, losses, damages, liabilities, costs, fines, penalties and expenses (including legal fees) arising out of your use of the Site or its Content and features, communications with NAT-Ts, or your breach of these Terms and Conditions, including but not limited to reliance by a user on any information obtained at the Site, or that result from mistakes, omissions, interruptions, deletion of files or e-mails, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorised access to our records or services.

 

NAT-TS specifically disclaims warranties, conditions and other terms of any kind, whether expressed or implied, including but not limited to warranties of title, implied warranties of merchantability, satisfactory quality or fitness for purpose.

 

Orders are delivered to you using third-party couriers/delivery agents. All items purchased from NAT-TS are made pursuant to a shipment contract. Title, and all risk of loss or damage to the products in your order pass to you upon tender of the item to the courier/delivery agent.

 

No oral advice or written information given by NAT-TS or its associates shall create a warranty.

 

NAT-TS, its affiliates and third parties shall be entitled to a reasonable extension of time for the performance of its obligations under this agreement when the delay is caused by circumstances beyond the reasonable control of NAT-Ts or its affiliates and third parties.

 

Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify, or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law, which cannot by law be excluded, restricted or modified. Where the exclusion or limitation of liability for consequential or incidental damages is not allowed, liability is limited to the fullest extent permitted by law.

 

 

Applicable Law and Consumer Protection

 

These Terms and Conditions are governed by the laws of New Zealand.

 

NAT-TS does not represent that the site or its Content complies with the laws of any country outside of New Zealand, or is appropriate or available for use in locations outside New Zealand. If you access this site from outside New Zealand, you do so at your own risk and you are responsible for making sure you comply with all applicable laws in the place you are located. You are not authorised to access the Site from any location where doing so would be illegal.

 

Where consumer protection legislation in New Zealand, or any consumer protection legislation in your jurisdiction, applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. Some countries have import restrictions on certain goods or materials. If you order products printed and delivered from outside of the country of your shipping/delivery address, you will become the importer and will be liable to pay local taxes or duties, and you will assume all liability under any customs or import laws and regulations.

 

 

Disputes

 

By accessing the Site, you accept that the laws of New Zealand will govern these Terms and Conditions and any dispute of any sort that might arise between you and NAT-TS, according to the laws in force and subject to the to the exclusive jurisdiction of the courts of New Zealand.
